1. Introduction

Welcome to DailyCal AI, operated by Nagorik Technologies Ltd. (“Company”, “we”, “our”, or “us”).

These Terms and Conditions (“Terms”) govern your access to and use of the DailyCal AI website, application, AI-powered features, and related services (collectively, the “Service”).

Our Privacy Policy also forms part of these Terms and explains how we collect, use, store, and share information in connection with the Service.

By accessing or using DailyCal AI, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.

2. AI Model Used for Service Delivery

DailyCal AI uses OpenAI’s GPT-5 model through the OpenAI API to provide its AI-powered functionalities.

The AI model is used to process user requests and generate AI-powered responses and recommendations within the Service.

The availability, capabilities, technical specifications, or version of the AI model may change from time to time if the underlying AI provider updates, replaces, or improves the model or if necessary for the continued operation of the Service.

Any such changes will not affect the core purpose of the Service, and we may update these Terms where appropriate.

3. AI-Generated Information

DailyCal AI uses artificial intelligence to provide responses, recommendations, calculations, insights, and other functionality.

AI-generated information may not always be accurate, complete, current, or suitable for every individual situation.

Users should independently verify important information before relying on it.

DailyCal AI is not a substitute for professional medical, financial, legal, nutritional, or other professional advice where such advice is required.

4. User Communications and Marketing

By using the Service, you may receive service-related communications, including account notifications, subscription information, security alerts, product updates, and other necessary communications.

5. Purchases and Payments

6. Subscriptions and Auto-Renewal

Certain DailyCal AI services may be offered on a recurring subscription basis.

The applicable subscription price, billing cycle, features, and other applicable terms will be communicated to the user at the time of purchase.

Unless cancelled before the applicable renewal date, a subscription may automatically renew according to the selected subscription plan.

Users may cancel subscription renewal through the applicable cancellation mechanism or by contacting support@nagorik.tech.

If automatic payment fails, access to subscription features may be suspended or terminated.

7. Free Trials

Where a free trial is offered, the applicable trial duration and conditions will be communicated to the user at the time of activation.

If payment information is required for a free trial, the applicable subscription fee may be charged after the trial period ends unless the subscription is cancelled before the applicable renewal date.

We reserve the right to modify or discontinue free trial offers at any time.

8. Refunds and Cancellation

Subscriptions may generally be cancelled at any time. Unless otherwise required by applicable law or expressly stated for a particular offer, cancellation does not result in a refund for a subscription period that has already commenced.

After cancellation, users may continue to access the Service until the end of the applicable paid subscription period, unless otherwise specified.

For one-time purchases, cancellation or refund availability may depend on the nature of the purchase and applicable payment-provider rules.

9. User Data and AI Processing

To provide AI functionality, information submitted by users may need to be processed by our AI technology provider.

When a user submits information, prompts, questions, or other content for AI processing, such information may be securely transmitted to OpenAI through the OpenAI API for the purpose of generating the requested AI response.

We do not sell user prompts, AI conversations, or uploaded user content to third parties.

DailyCal AI may use or integrate with third-party services, including OpenAI, payment providers, analytics providers, cloud infrastructure providers, and other technology providers.

Third-party services are governed by their respective terms and privacy policies. We are not responsible for the independent practices of third-party services outside our control.

17. Disclaimer of Warranty

THE SERVICE AND AI-GENERATED CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

To the maximum extent permitted by law, we make no warranties that the Service will be uninterrupted, error-free, secure, accurate, complete, reliable, or suitable for a particular purpose.

AI-generated information should not be treated as professional advice.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Nagorik Technologies Ltd. shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of DailyCal AI or reliance on AI-generated information.

19. Changes to the Service and Terms

We may modify, update, add, or remove features of the Service, including AI functionality, from time to time.

We may also update these Terms to reflect changes in the Service, technology, legal requirements, or our business practices.

The updated Terms will be published on the DailyCal AI website.

These Terms shall be governed by and interpreted in accordance with the applicable laws of Bangladesh.
